Definitions
- "Loqma" or "the platform": the POS and restaurant management system available on the web and device apps.
- "Subscriber" or "the business": the commercial entity that created an account and subscribed to the service.
- "User": any person using the platform under the subscriber's account (owner, manager, cashier, and so on).
- "Business data": all data the subscriber enters or that results from its use of the platform, such as menus, orders, invoices, and its customers' data.
Acceptance and changes to the terms
Using the platform means you accept these terms and the privacy policy that complements them. We may update the terms from time to time; for material changes we will notify subscribers through the platform or registered contact channels a reasonable period before they take effect. Continuing to use the platform after that date constitutes acceptance.
Accounts and eligibility
Creating an account requires that the business is properly licensed to operate in the Kingdom of Saudi Arabia and that the information provided at registration is accurate and kept up to date.
- You are responsible for the confidentiality of login credentials and staff PIN codes, and for all activity under your account.
- Permissions must match each user's actual role, and access must be revoked for anyone who leaves the business.
- Notify us immediately if you suspect any unauthorized use of your account.
Subscription, fees, and renewal
The platform is offered as a paid subscription per branch, at the prices and plans published on the pricing section; all prices include VAT unless stated otherwise.
- Subscriptions renew automatically at the end of each term (monthly or annual) unless the subscriber stops renewal before the renewal date.
- A paid term is non-refundable after it starts, except where the law requires or where we agree in writing.
- Prices may change in the future, effective from the next renewal cycle and with at least 30 days prior notice.
- Unpaid fees may lead to suspension of access until settled.
Electronic payments and processing fees
The Loqma subscription is fixed, and the platform charges no commission on register sales. Online payment services (such as pay online or pay at the table) are provided through a licensed third-party payment gateway and are subject to processing fees set by that gateway, shown clearly before you activate the service.
The payment-processing relationship is between the business and the payment gateway; Loqma is not a party to collecting or holding customer funds.
Subscriber responsibilities
- The accuracy of menus, prices, taxes, and discounts entered into the platform, and of the invoices it issues to your customers.
- Compliance with the regulations that apply to your business, including ZATCA e-invoicing and SFDA requirements - the platform helps with compliance but does not replace your legal responsibility.
- Obtaining any consents required from your customers when entering their data into the platform (for example, loyalty programs).
- Using suitable, secure devices and networks to run your points of sale.
Acceptable use
- The platform may not be used for any unlawful activity or outside its intended commercial purpose.
- You may not attempt to breach the platform, bypass security controls, or deliberately overload its systems.
- You may not resell, sublicense, or copy parts of the platform without a written agreement.
- You may not use the platform's data to build a competing product or for unauthorized data extraction.
Business data and ownership
Business data belongs to the subscriber. By using the platform you grant us a limited license to process that data as needed to operate, improve, and support the service, in line with the privacy policy.
- You can export your core data (reports, invoices, customers) from the platform during your subscription.
- After the subscription ends we allow a reasonable period to export your data before it is archived or deleted, subject to statutory retention periods for tax records.
Intellectual property
The platform, its design, the "Loqma" mark, and all related intellectual property rights belong to us or our licensors. The subscription grants no rights in the trademarks or the platform's code, other than the right to use the service under these terms.
Availability, maintenance, and updates
We aim to keep the platform available around the clock, with occasional scheduled maintenance or unexpected outages. The register keeps working offline and syncs when the network returns, but some services depend on third parties (payment gateways, delivery platforms, the e-invoicing system) and may be affected by their availability.
We may add features, modify the platform, or retire minor features while taking care not to materially degrade the core service.
Limitation of liability
The platform is provided as is. To the extent permitted by law, we are not liable for indirect or consequential damages such as lost profit or lost business opportunity. In all cases our total liability for any claim shall not exceed the subscription fees paid by the subscriber in the twelve months preceding the claim.
Nothing above limits any liability that cannot be limited or excluded under applicable law.
Suspension and termination
- We may suspend or terminate an account for a material breach of these terms or for use that threatens the platform or its users, notifying the subscriber where possible.
- The subscriber may stop renewal at any time from the dashboard or by contacting us; access continues until the end of the paid term.
- Upon termination access ends, and the data-export provisions in the business-data section apply.
Governing law and jurisdiction
These terms are governed by the laws of the Kingdom of Saudi Arabia, and any dispute arising from them falls under the jurisdiction of the competent judicial authorities in the Kingdom, unless otherwise agreed in writing.
